Terms and Conditions for Tree Surgeon Walthamforest Services
These Terms and Conditions set out the basis on which tree surgery, arboricultural maintenance, and related outdoor works are provided by a tree surgeon in Walthamforest or by any associated arborist team operating under the same service framework. By booking or accepting a quotation, the customer agrees to these terms in full. They are designed to promote clarity, safety, lawful waste handling, and fair dealing for both parties. Throughout this document, references to tree surgery services, arborist services, or tree care work should be understood to include pruning, reductions, crown lifting, felling, stump work, emergency callouts, and site clearance where agreed in writing.
These terms apply to domestic, commercial, and communal properties unless varied by a separate written contract. They do not replace statutory rights that may apply under UK consumer law, nor do they limit any duties imposed by health and safety, environmental, or waste legislation. If a specific service is subject to a separate quotation, method statement, or permit requirement, those documents may be read together with these Terms and Conditions.
The customer is responsible for ensuring that they have authority to instruct the works, including permission from landlords, managing agents, freeholders, neighbours where necessary, and any relevant local or tree-preservation authority. The service provider will use reasonable skill and care, but the customer remains responsible for the accuracy of information supplied about ownership, access, underground services, hidden hazards, and any restrictions affecting the site.
Booking Process
Bookings are normally made after an initial enquiry and, where appropriate, a site assessment. A quotation may be based on photographs, measurements, descriptions, or an in-person inspection. Where a quotation is given without a site visit, it is subject to change if the actual conditions differ from those described. Any acceptance of a quote is treated as agreement to the scope, price basis, and assumptions stated within it.The booking is confirmed when the customer accepts the quotation and the service provider acknowledges the booking in writing, electronically, or by recorded message. Dates and arrival times are estimates unless a specific timed appointment has been expressly agreed. Weather, access issues, traffic, equipment failure, or unforeseen safety matters may require rescheduling. In such cases, the provider will make reasonable efforts to rearrange the work promptly.
The customer must provide accurate site details, including parking restrictions, access routes, the presence of overhead lines, tree guards, pets, fragile surfaces, shared boundaries, or known hazards. If access is obstructed or the job cannot proceed safely because of inaccurate information, the provider may charge a call-out fee, wasted attendance fee, or additional labour costs. The customer should also ensure that all relevant utilities, alarms, sprinkler systems, and security arrangements are managed before work begins.
Scope of Services and Variations
Every quotation is based on the agreed scope only. If the customer requests extra work, or if the operatives discover additional issues once work has begun, any variation may require a revised price and new completion estimate. Examples include additional stem sections, unexpected deadwood, concealed decay, restricted crane access, or the need for specialist machinery. The tree surgery contractor may suspend work until the revised scope is accepted.Where the service involves felling or pruning, the customer accepts that trees are living structures and that outcomes can vary depending on species, age, condition, weather, and previous management. A tree surgeon service cannot guarantee exact regrowth, long-term stability, or the future health of a tree unless a specific written guarantee has been given. Advice provided verbally is offered in good faith but should be treated as professional opinion based on the information available at the time.
Emergency and urgent callout services are provided on a best-efforts basis. Priority will be given to making the site safe and reducing immediate risk, rather than undertaking full aesthetic finishing. Where emergency works are required, the customer acknowledges that temporary measures may be necessary and that further follow-up work may be recommended.
Payments
Prices are usually quoted in pounds sterling and may be subject to VAT where applicable. Unless otherwise agreed, invoices become due on completion of the work or within the timeframe stated on the invoice. The service provider may request a deposit, staged payment, or full prepayment for larger projects, specialist equipment, waste-heavy jobs, or emergency bookings. Acceptance of a quote does not alter the payment terms shown on the invoice or written confirmation.
Payment should be made by the methods specified at the time of booking or invoicing. If a customer fails to pay by the due date, the service provider reserves the right to charge statutory interest and reasonable recovery costs in accordance with applicable law. Any dispute about a charge must be raised promptly and with clear reasons. Undisputed sums remain payable even where part of the invoice is contested.
The customer must not withhold payment because of minor aesthetic issues, changes that were necessary for safety reasons, or delays caused by weather or access restrictions outside the provider’s control. Where a reduction, removal, or arborist maintenance job creates arisings, the quotation will normally specify whether clearance, disposal, chipping, or firewood processing is included. If not included, these services may be charged separately.
Cancellations and Rescheduling
The customer may cancel a booking, but cancellation charges may apply depending on how much notice is given and whether materials, labour, permits, or hired equipment have already been arranged. If the customer cancels at short notice, especially on the day of the appointment, the provider may charge a fair proportion of the agreed fee to cover lost time, preparatory work, and administrative costs. If the service provider must cancel due to weather, safety concerns, illness, breakdown, or other unavoidable reasons, the booking will normally be rescheduled without penalty to the customer. The provider is not responsible for indirect losses arising from cancellation or postponement, such as missed contractor attendance, venue arrangements, or property sale delays. Customers are encouraged to avoid arranging irreversible activities until the tree work is confirmed as completed.
Where access is denied, the site is not ready, or consent documentation is missing, the provider may treat the booking as a cancellation or failed attendance. In some cases, a partial charge may be applied for the wasted visit. This is especially relevant where a tree cutting service has allocated machinery, staff, or traffic management for a specific time window.
Liability and Customer Responsibilities
The service provider will carry out work with reasonable care and skill, using competent operatives and appropriate equipment. However, tree surgery involves inherent risks, including falling branches, underground obstructions, hidden defects, flying debris, and unpredictable tree behaviour. The customer must keep people, pets, and belongings away from the work area unless the team has confirmed that it is safe to enter. The service provider will not be liable for pre-existing defects, hidden decay, unstable fences, damaged paving, brittle conservatories, weak boundary features, or failures caused by age or wear. Trees may be inspected visually, but not every internal fault can be identified without invasive testing. The customer accepts that occasional minor scarring, surface disturbance, or residual marks may occur as a normal consequence of professional tree operations, especially on mature or previously stressed trees.
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law. Subject to that, the service provider will not be liable for indirect or consequential losses, loss of profit, business interruption, loss of amenity, or third-party claims arising from information supplied incorrectly by the customer. The customer remains responsible for obtaining any insurance they consider necessary for the property or the works.
The customer must disclose known hazards such as asbestos, buried services, defective structures, Japanese knotweed, aggressive pests, or contaminated ground. If such conditions are discovered during the works, the provider may stop or alter the job for safety reasons. Additional charges may apply if specialist methods, machinery, or protective measures are needed. If the customer asks the team to proceed against professional advice, the provider may decline and leave the site safe.
Waste Regulations and Site Clearance
All green waste, timber, brushwood, and associated arisings generated by the works remain subject to waste management rules. Unless otherwise agreed in writing, the service provider will decide how the waste is handled, transported, recycled, chipped, composted, or disposed of in compliance with applicable UK waste regulations. Waste transfer may be carried out using licensed carriers and authorised facilities where required. The customer must not assume that all waste will be removed unless this is clearly included in the quotation.
Where the customer requests to keep timber, woodchip, or other materials, this must be agreed in advance and may affect pricing, site tidiness, or vehicle access. Some waste may be retained temporarily on site if that is necessary for efficient removal, segregation, or processing. The provider will aim to leave the area reasonably tidy, but a perfect finish cannot always be guaranteed due to ground conditions, weather, or the nature of the vegetation removed.
The customer acknowledges that the service provider may need to comply with environmental obligations relating to protected species, nesting birds, tree preservation orders, conservation areas, and other planning or ecological controls. If works must be postponed because of legal restrictions, the provider will not be liable for resulting delay. The customer is responsible for obtaining any necessary consent before non-emergency work begins, unless the parties have expressly agreed that the provider will handle such checks as part of the service.
Access, Delays, and Force Majeure
The customer must ensure reasonable access to the work area and must remove or secure obstacles where practical. The provider is entitled to park, unload, and place equipment as needed for safe performance of the work, subject to lawful restrictions. If access is unsafe or insufficient, work may be delayed, reduced in scope, or cancelled, with any resulting costs charged to the customer where appropriate. The service provider will not be responsible for delays caused by events outside reasonable control, including severe weather, storms, flooding, fire, strikes, road closures, civil disruption, or supply chain failures. Such events may also affect the availability of emergency tree surgeon services and the timing of follow-up visits. In all cases, the provider will use reasonable efforts to minimise disruption and resume work as soon as practical.
If the work is interrupted by unexpected hazards or safety concerns, the team may secure the area and leave it in a safe condition. Further attendance may then be arranged under a revised booking. The customer accepts that arboricultural work can be affected by conditions that are not foreseeable at the point of quotation.
Complaints and Rectification
If the customer believes the work has not been carried out in accordance with the agreed scope, they should notify the service provider within a reasonable time and provide enough detail to allow the matter to be reviewed. The provider may inspect the site, request photographs, or arrange a revisit if appropriate. Where a genuine issue exists, the provider’s first option will ordinarily be to correct the problem or offer a fair resolution.
Minor variations in appearance, shape, or finish do not automatically amount to a breach of contract, especially where the work involved living trees, seasonal conditions, or safety-led decisions. A tree crown, stump, or hedge may continue to change after treatment due to weather, sap flow, disease progression, or natural growth. The customer should therefore understand that the service is delivered professionally but cannot create absolute uniformity in every case.
Any dispute that cannot be resolved amicably should be raised in writing and accompanied by supporting information. The service provider may ask for access to the site or for permission to inspect the relevant tree or area. Both parties should act reasonably and try to reduce any loss or unnecessary escalation.
Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising out of or in connection with the services, quotation, payment, or interpretation of these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless another forum is required by applicable law.If any part of these terms is found to be unenforceable, unlawful, or invalid, the remaining provisions will continue in full force to the extent permitted by law. No waiver of any term will be effective unless agreed in writing by the service provider. A failure to exercise any right or remedy will not prevent that right or remedy being exercised later.
By proceeding with a booking, accepting a quotation, or allowing the service provider to begin work, the customer confirms that they have read, understood, and agreed to these Terms and Conditions. These terms are intended to support safe, lawful, and professional arboricultural work while allowing the customer to receive a clear and reliable tree surgeon Walthamforest service under fair and transparent conditions.
